The San José Museum of Art (SJMA) is committed to protecting your privacy. This Privacy Policy governs information that you provide to us or that we learn from your use of this website and tells you how we may collect, use, and in some cases, share this information. This Privacy Policy is incorporated into the Terms and Conditions of Use for this website.  By accessing, browsing and/or using this website you are deemed to have agreed to SJMA’s Terms and Conditions of Use and this Privacy Policy. If you choose not to accept the Terms and Conditions or this Privacy Policy, then please exit this website and refrain from using it.

Modification

SJMA reserves the right, in its discretion, to change, modify, add, or remove portions of this Privacy Policy as well as the Terms and Conditions of Use into which it is incorporated at any time. Please periodically check the Privacy Policy and the Terms and Conditions of Use for changes. By accessing, browsing, and/or using this website after changes to either the Terms and Conditions of Use or the Privacy Policy have been posted, you agree to accept those changes. 

The Information that SJMA Collects

User Provided Personally Identifiable Information (PII)

You may provide to SJMA what is generally called “personally identifiable information” (PII). Categories of PII that you provide include:  your first and last name, email address, home address, postal address, billing address, phone numbers, and credit card information.

For example, when you make a purchase a Museum membership, you provide PII to enable SJMA to complete the membership process. There are areas within the SJMA websites where you may voluntarily provide your name and e-mail address for various purposes. For example, you may provide such information: to indicate that you would like to receive direct e-mail and/or regular mail about the Museum; to indicate that you would like to receive information about SJMA's education or volunteer programs; to purchase or reserve a ticket to an event; and/or as part of posting comments regarding images of permanent collection works. SJMA’s website collects PII for such requested services such as membership purchases and renewals, program registrations, electronic newsletters and mailings, and general inquiries.

Cookies

We use cookies, which are small pieces of information – a small text file containing a string of alphanumeric characters --sent to your browser from a web server by a website that you visit. The cookies do not collect the personally identifiable information described above.  Cookies are used to track usage patterns, traffic trends, and customer behavior. This data contains information about you that SJMA may use to enhance your visit to SJMA's websites. For example, one cookie SJMA may store can remember what kind of visual images you viewed upon your previous visits to SJMA's website and will assist in providing you with the experience of viewing new images upon your next visit. You do not have to accept any of SJMA's cookies to enjoy and use the SJMA website; the rejection of cookies may, however, alter your website visit. Automatically Collected Non-Personally Identifiable Information

SJMA may collect information from visitors to the SJMA website that is not personally identifiable, including the visitor's operating system, browser, domain name, IP address, and the specific web pages on SJMA's website that are accessed or visited, the web pages or sites that you visit just before or just after the SJMA website, and the dates and times that you visit. 

The Way SJMA Uses Information 

SJMA uses the information that we collect to provide various features and services. SJMA may use the information that we collect to understand trends and preferences; to improve the SJMA website; to improve our promotional efforts, membership drives, and fundraising efforts; and to create new features and functionality. 

SJMA may use automatically collected information and cookies information to provide custom, personalized content and information; to monitor the effectiveness of promotional efforts, membership drives, or fundraising efforts; to monitor aggregate usage metrics such as total number of visitors and pages viewed; and to provide customized advertising that may be of interest to you.

SJMA will use the information that you provide to SJMA or to any third party vendor, without further consent for administrative purposes and to send promotional, fundraising, and membership-related communication to you unless you opt-out of receiving such information.

The Way SJMA Discloses Information

SJMA may disclose both personal identifiable and automatically collected information to the following categories of third parties: web maintenance service providers, non-profit organizations, community groups, and cultural institutions, and select organizations.  For example, SJMA may disclose both personal identifiable and automatically collected information to businesses, organizations, or persons that process such information on our behalf to provide website maintenance, to provide various features and services including without limitation to enable sending of promotional, fundraising, and membership-related communications, to assist us in improving the SJMA website, and to create new features. 

You should be aware that your name and other contact information may be exchanged with other non-profit organizations, community groups, or cultural institutions as well as other select organizations. SJMA only shares names mailing addresses related to ticket purchasers (including membership purchasers). Email addresses and other donor information is not shared. These organizations may contact you to promote products or services that they offer. Such contacts will only be made with our consent and we will only grant consent when we consider the offer to be of personal interest and benefit to you. SJMA does not share this information with other organizations for fundraising purposes. Individuals are given the option of not having their information shared in this manner.

SJMA may share automatically collected and other aggregate non personally-identifiable information with third parties to assist them in understanding the usage patterns for content, services, promotions, and/or functionality on the SJMA website and to enable them to provide customized advertising, marketing, and/or promotional materials that may be of interest to you.

SJMA will disclose personal information when required to do so in accordance with a court order, subpoena, or similar legal order, or state or local law.

Third-Party Service Providers

SJMA reserves the right to contract with secure third-party vendors to conduct specific e-commerce transactions. For e-commerce transactions, the collection of personally identifiable information will be required.  This information will be processed through and stored on secure servers. 

SJMA’s website may contain links to other websites, products, or services that SJMA does not own or operate. 

At times, websites hosted by third party service providers or partners may appear as if you are still on the SJMA website.  To tell whether you are on the SJMA website or viewing third-party content, simply check the address of the page in your browser’s address window. We encourage you to read the privacy statements of each and every third-party website and service provider before providing any personally identifiable information to its operators. SJMA is not responsible for the privacy practices of third parties. If you choose to visit or use any third-party websites, including those offered by our third-party service providers or other partners, please be aware that this Privacy Policy will not apply to information that you disclose to third parties.

Unaffiliated Third-Party Links

SJMA’s website may contain links to other websites.  We encourage all of our partners, contributors, and third parties to implement practices and policies that respect the privacy of our users. However, SJMA is not responsible for the privacy practices or content of such websites. 

Children

SJMA does not solicit personal information from minors. Consistent with the Children’s Online Privacy Protection Act of 1998, SJMA does not knowingly request personally identifiable information from anyone under the age of thirteen (13) without prior verifiable parental consent.  If SJMA becomes aware that we have such information without prior verifiable parental consent, we will remove the information from our files.

Email Policy

SJMA regularly send emails to provide highlights of upcoming exhibitions and programs. You may unsubscribe to the email list at any time by clicking on the unsubscribe link in the email that you receive.

Opting Out

Upon request, SJMA will (1) remove your personal information from our database; (2) correct personal information that is erroneous; (3) permit you to "opt out" of further e-mail or regular mail contact (except if SJMA needs to communicate with you regarding a membership or to notify you regarding major changes to services); 4) permit you to opt out of mailing lists shared with other cultural organizations for promotional purposes.
